Mediation is available in many state high courts in Nigeria including Lagos, FCT, Rivers, Delta and Cross River States.
In Lagos State mediation is encouraged even before you file a case in court. You can only go ahead to sue when the other party doesn't want to settle amicably.
Even after your case has been filed the judge tries to settle the dispute amicably in a Case Management Conference (CMC). CMC is always interesting because the parties are encouraged to participate fully unlike a formal court session. It's an informal court session where the judge and lawyers don't have to wear their full regalia. The parties are free to speak and say what they want and the judge only moderates the discussion.
Have you witnessed a CMC before? What was the experience like?
